WHY IS THERE A NEED FOR FLEXIBLE WORK SCHEDULES?

Many companies in Asia are slowly sending their employees back to the office as the world began to reopen. With the coronavirus infections soaring past seven million and growing, working remotely will continue to be a facet in the region.

Having the goal of avoiding densely packed work spaces that facilitate viral spread of the virus, most firms are resorting to flexible work schedules so that at least half the staff can continue working from home, while the rest can return to the office.

While a massive shift to working from home has helped firms stay afloat and sparked a rethinking of the way offices can be run, the consensus is that not everyone can pivot to a home-run office and remain efficient.

Telecommuting Act

The concept of employees working from home in the Philippines is not new. Even before the advent of COVID-19, employers have always had the prerogative to where an employee should perform his or her work. Whether it be in the office premises, in the field, at home, or elsewhere.

The pandemic caused by COVID-19 outbreak has affected how work is done in the Philippines. Whereas before long hours of stay in the office was the norm, the imposition of the Enhanced Community Quarantine (ECQ) forced employers of non-essential industries to recognize that work can be done even outside the office premises, such as through Work-From-Home (WFH) arrangements.

These WFH arrangements have been widely embraced and are expected to linger even after the ECQ has been lifted. There is, thus, a basic need for understanding as to how WFH arrangements fit in the labor law landscape and how they should be legally implemented.

Signed into law last December 2018 was Republic Act No. 11165 or also known as the Telecommuting Act. It is An Act institutionalizing Telecommuting as an alternative work arrangement for employees in private sectors.

Salient features of the Telecommuting Act:

  • Under Section 3, employers can offer a work-from-home arrangement “on a voluntary basis or as a result of collective bargaining.” However, offering this arrangement and the terms and conditions must not fall below minimum labor standards.

  • Under Section 4, all telecommuting individuals are covered under the same set of “applicable rules and existing Collective Bargaining Agreements (CBAs), if any.”

  • Under Section 5, data protection for employees who prefer to work from an alternative workplace is greatly stressed. Both parties shall agree on minimum standards that will protect their personal information while utilizing the available technology and software to further enhance their security and privacy.
